La responsabilidad patrimonial del legislador

Analysis of the phenomenon of state responsibility for legislative acts has been a subject of study that has been developed both in midtwentieth century doctrine and international jurisprudence. In the Colombian case, Article 90 of the Constitution of 1991 introduced the constitutional principle of patrimonial responsibility of the state, without this meaning that Council of State jurisprudence would find the basis of this responsibility in different provisions of the Constitution of 1886, such as articles 2, 16 and 30, constitutional provisions which establish the principle of legality, the duty of the state to protect the life, honor and property of citizens, as well as to guarantee the right to private property and other acquired rights of persons. Nevertheless, the first decisions relating to this title of imputation in Colombia were handed down by the Maximum Colombian Tribunal of Administrative Litigation in 1998 and by the Constitutional Court through decision C-038 of 2006, a judicial writ that established some of the characteristics of this legal figure.Analizar el fenómeno de la responsabilidad del Estado causada por los hechos del Legislador ha sido un trabajo desarrollado por la doctrina y la jurisprudencia internacional a mediados del siglo XX. Para el caso colombiano, la Constitución de 1991 introdujo en su artículo 90 el fundamento constitucional de la responsabilidad patrimonial del Estado, sin que esto signifique que la jurisprudencia del Consejo de Estado encontrara las bases de esta responsabilidad en diferentes disposiciones de la Constitución de 1886 tales como los artículos 2°, 16 y 30, normas constitucionales que consagraban el principio de legalidad, el deber del Estado para proteger la vida, honra y bienes de los ciudadanos, así como el de garantizar el derecho a la propiedad privada y demás derechos de las personas que tuviesen el carácter de adquiridos. Sin embargo, los primeros fallos relacionados con este título de imputación en Colombia fueron emitidos por el máximo Tribunal de lo Contencioso Administrativo colombiano en 1998 y por la Corte Constitucional, a través de la sentencia C-038 de 2006, providencia judicial que estableció algunas de las características que posee esta figura jurídica
