PERLINDUNGAN HUKUM TERHADAP HAK TERSANGKA DALAM MEMBERIKAN KETERANGAN SECARA BEBAS TANPA ADANYA TEKANAN DARI SIAPAPUN DAN ATAU DALAM BENTUK APAPUN DALAM PROSES PENYIDIKAN (Studi di Polres Kabupaten Tanah Bumbu, Kalimantan Selatan)

Legal protection of suspect rights in providing free information in the investigation process became the subject of the present study. The aim was to know the legal protection implementation of suspect rights in providing free information without any pressure from anyone and or in any form, and what factor caused the legal protection for suspect rights is not implemented yet in Tanah Bumbu district police station. This present study used sociao legal research as the research method. The primer data was gotten from the field and the secondary data was from documentation and legislation. The data collection technique was direct interview with the former suspect and the investigative boss in Tanah Bumbu district police station. The result of the study showed that the former suspect experienced violence and intimidation in the investigation process and after it. The conclusion is the legal protection for suspect rights in providing free information have not implemented effectively yet and the factors caused the legal protection for suspect rights have not implemented yet is because the procedure deviation which is not explaining the intent and the suspect rights, not accompanied by legal advisors, and weak supervision of investigative bosses. The suggestions from the researcher is it is very important that there is transparency from the police institution and external supervision of the performance of investigative officers and investigative activities as well as socialization and education to the community
