ANALISIS YURIDIS SOSIOLOGIS TENTANG PERJUDIAN MENJELANG PELAKSANAAN PILKADA KOTA BATU TAHUN 2017 (Studi di Polres Batu)

Gambling is any game that basically hopes for winning which generally depends on the luck just by using money or goods at stake. Gambling ahead of elections Pilkada often become an increasingly widespread phenomenon occurs especially in the election of the Regional Head of Batu City in 2017. This research was conducted at Polres Batu in order to understand and know the pattern and form of gambling that appeared before the implementation of election as well as to understand and know the police effort in dealing with the law of gambling before the election of election. This research uses sociological juridical approach method, primary data source obtained from field, and secondary data source from documentation and Legislation and data collection technique in the form of interview with respondent, documentation, and direct observation to Batu Polres research location as the primary data collection . Then the data of the research are analyzed descriptively qualitative. Based on the results of research on the pattern and form of gambling before the election there are various ways, among others, by way of sound comparison, by playing the percentage of voice and also the challenge of guessing the name of the paslon that is bet. While the police effort to prosecute gambling before the elections consists of Penal (Law) which is done by arresting and applying Article 303 and / or 303 bis paragraph (1) of the Criminal Code to gamblers and Non Penal efforts by holding legal counseling or socialization and holding Patrol and supervision in areas prone to gambling. Based on the analysis of the author of the police in applying the legislation about gambling has not been effective and the efforts of the Police in socializing for the prevention of gambling has not been fully effective because the way in socializing has not been right target, while to minimize and prevent gambling crime especially that happened in Batu city 2017 based the observation of the authors of the Police must make an integral penal and non penal effort, but it is considered the most effective use of non penal efforts that is through legal counseling or socialization that can be done by scholars' and community leaders. In conclusion, gambling ahead of the election is contrary to Article 303 and 303 bis paragraph (1) of the Criminal Code and may be punished in accordance with applicable regulations
