KAJIAN YURIDIS KESAMAAN DI MUKA HUKUM TERHADAP KORBAN TINDAK PIDANA DALAM SISTEM PERADILAN PIDANA INDONESIA

Victims of criminal act are those who suffer losses on the crime. In the victimology study there are two types of protection to the victim, the right to service and procedural right. Of the two types of protection to victims of the crime. Issues to be studie in this paper are (1) Does Indonesia’s criminal justice system provide equal legal standing to victims of criminal act (2) What is the ideal consturtion of the protection and recognition of equality before the law to provide justice for victims of crime in connection with ius constituendum Indonesia;s criminal justice system. The method in this paper is to use the type juridical research that sees legislation as a norm in society. In the paper obtained result victim of criminal act not have equality before the law right. So then ideal construction is to add the type of compensation as a type of punishment and give the victim the to do legal effort. Out of the paper victim of the criminal act achive equality before the law by means of offendr of criminal act and realize mandate the constitution
