Pelaksanaan Diversi Perkara Tindak Pidana Kecelakaan Lalu Lintas Yang Dilakukan Oleh Anak. (Studi Kasus di Polres Kabupaten Blitar)

The rise of children driving a motor vehicle causing traffic accidents. In the provisions of Law no. 11 Year 2012 on Child Criminal Justice System for children in conflict with the law is made a diversion effort as the transfer of settlement of the Child case from criminal justice process to process outside of criminal court. Based on this matter in this research there are two problem formulation, as follows: 1) How does the Completion of Diversion Conducted by Police Investigator Blitar Against The Settlement Of Case Of Traffic Accident By Child? 2) What Are the Considerations of Investigators Conducting Diversion in Resolving Traffic Accident Cases by Children? This research method was using research type of Empirical Juridical, using research approach of Sociological Juridical, research location was in Blitar Regency precisely at PolresBlitar. Based on the research results that in the implementation of the diversion conducted by Traffic Investigator only as a facilitator while in the implementation of diversion it is done by bapas. Reasons for the Implementation of Diversion, namely: a. It is not an Intentional Crime. b. Good Faith. c. Authority of Investigator. d.No harm to the Public Interest. e. Presence of Considerations from Various Parties f. Not a Repeat Criminal Acts g. Age of child h. Many Traffic Accidents are settled by Deliberation
