INTERNATIONAL RESPONSIBILITY OF STATES IN CASES OF GENOCIDE, THE DECISION OF THE INTERNATIONAL COURT OF JUSTICE IN THE CASE OF SREBRENICA

Este artículo analiza un caso ante la Corte Internacional de Justicia (CIJ)en el que se trató de una eventual responsabilidad de la República Federalde Yugoslavia (FRY) por el genocidio cometido en Srebrenica por tropas dela República Srpska, una unidad de la República de Bosnia-Herzegovina.El análisis, basado integralmente en la sentencia de la CIJ, parte del estudiode las normas fundamentales de la Convención Internacional sobrela Prevención y Represión del Delito de Genocidio, estudia luego si losEstados están obligados a no cometer genocidio, y qué significa la expresión“destruir total o parcialmente un grupo”. Luego, analiza si el genocidio esatribuible a la FRY a la luz de la actuación de sus órganos de jure y si lastropas bosnio-serbias pueden ser consideradas órganos de facto de la FRY,de manera que se pueda atribuir a ésta la responsabilidad. El propósitoes puntualizar la diferencia de criterios entre la jurisprudencia de la CIJ yla del Tribunal Penal para la Antigua Yugoslavia, para concluir cómo losórganos judiciales no pueden atribuir a los Estados responsabilidad poractos de personas o grupos que no sean órganos de jure o de facto del Estado.The article refers to the judgment of the International Court of Justice in thecase of Bosnia and Herzegovina v. Serbia and Montenegro, in which Serbia(Federal Republic of Yugoslavia, FRY) was accused of having committedgenocide through troops of the Republic Srpska in Srebrenica. It considers theConvention on the Prevention and Punishment of the Crime of Genocide,the meaning of “total or partial destruction of a group”, and if those troopscould be considered de jure or de facto organs of the FRY, a basic definitionfor attributing responsibility to it. The purpose is to point out to the differencesbetween the jurisprudences of the International Court of Justice andof the International Criminal Tribunal for the Former Yugoslavia and toconclude that the international judicial organs cannot attribute responsibilityto a State if the acts were committed by persons or groups which are not dejure or de facto organs of the State
