LA PROTECCIÓN DEL MEDIO AMBIENTE Y SU JERARQUÍA NORMATIVA EN DERECHO INTERNACIONAL

The article addresses the normative hierarchy in international law of the principle according to which States have the responsibility to ensure that activities within their jurisdiction or control do not cause damage to the environment of ther States or of areas beyond the limits of national jurisdiction. The analysis focuses on three concepts which entail certain hierarchy in international law, namely those of peremptory norms, obligations erga omnes and essential interests. The author concludes that, in the present state of international law, the principle of environmental protection constitutes both an obligation erga omnes and an essential interest of the State, capable of founding an allegation of state of necessity. At the same time, this principle has a significant heuristic value to the extent that it provides an illustration of the differences between the concepts of obligations erga omnes, esencial interests and that of peremptory norms.El presente artículo analiza la jerarquía normativa en derecho internacional del principio según el cual los Estados tienen la obligación de asegurar que las actividades que se lleven a cabo dentro de su jurisdicción o bajo su control no perjudiquen al medio ambiente de otros Estados o de zonas situadas fuera detoda jurisdicción nacional. El análisis se concentra en tres conceptos que suponen cierta jerarquía en derecho internacional, a saber los conceptos de jus cogens, obligaciones erga omnes e intereses esenciales. El autor concluye que, en el estado actual del derecho internacional, el principio de protección medioambiental constituye tanto una obligación erga omnes como un interés esencial del Estado, susceptible de fundar una alegación de estado de necesidad. Al mismo tiempo, dicho principio posee un valor heurístico significativo ya que constituye una ilustración clara de las diferencias entre los conceptos de obligaciones erga omnes e intereses esenciales y el jus cogens
