COMPLIANCE COMPETITION: CONTROL AND COMBATING THE ILLICIT PRACTICES OF THE ECONOMIC MARKET

<p>The purpose of this paper is to investigate the extent to which compliance may contribute to the development of the best competitive practices. The actions could the State takes to control, oppose and restrain illicit acts inside the economic market, as the agent that punishes infractions against the economic order. There were also considered the new anti-corruption rules developed by the Brazilian Administrative Council for Economic Defense (CADE), as it encourages self-regulation and the benefits from the adoption of the so-called soft law in its Compliance Guide. On the other hand, it was studied how compliance supports companies to comply with the Competition Law and what is the expected behavior associated to the antitrust legislation (Law 12.529/2011), regarding prevention and repression of abuse of economic power, violations and infractions of the economic order, which affect freedom of initiative, free competition, the social function of property and the protection of consumers.
