Tinjauan Yuridis Eksekusi Terhadap Benda Sebagai Objek Perjanjian Jaminan Fidusia Menurut UU No. 42 Tahun 1999 (Studi Kasus di PD. BPR BKK Boyolali Kecamatan Ngemplak Kabupaten Boyolali)

This study aims to determine the implementation process of object execution with fiduciary guarantee and constraints faced in execution of object execution agreement with fiduciary guarantee. The research method uses a descriptive juridical empirical approach. This type of data consists of primary data, namely interviews and secondary data derived from primary, secondary and tertiary legal sources, data collection methods through interviews and observations, then analyzed qualitatively. The result of the research shows that the execution process is in accordance with Article 29 of Law Number 42 of 1999 concerning Fiduciary Security, namely to make a subpoena, if by subpoena still doing a breach of contract, then confiscation and sale of object object of fiduciary collateral through a public auction and repayment of the loan. If there is a residual proceeds from the sale after deducting the repayment of the receivables, the remaining proceeds are returned to the debtor, but if the sale is less than the debtor's debt, the debtor is obliged to repay the deficit. The constraints faced in the execution of fiduciary collateral objects if the debtor defaults is a closed and uncooperative attitude of the debtor, the debtor opposes and does not submit the object of fiduciary collateral, the object of fiduciary guarantee is transferred to a third party, the object of fiduciary collateral is destroyed and the value of the object is fiduciary
