Tinjauan Hukum Islam Terhadap Praktek Pembulatan Uang Sisa Pembelian (Studi Kasus Di Swalayan Relasi Jaya Surakarta)

By the development of increasingly advanced technology, the commerce has its own patterns to the more practical thing. Its technical implementation is no longer using ijāb and qabul. In the science of fiqh, it is called as Bay’ mu’āṭah (giving and receiving for each other) as there is an action of the parties involved who have mutual understanding on the transaction with its all legal consequences. This kind of activity often occurs in supermarkets or any markets which have no bargaining process in its transaction. The buyer has usually known the price as it is written on the price tag; therefore, there will be no special offers towards the seller. It is also applied to the rounding off the change when doing a transaction. An uneven price will usually be rounded off either round down or round up. It happens since the seller has no uneven money as change due to particular reasons. The purpose of this study is to know and to explain about the practice of rounding off the change reviewed from Islamic law. The type of this research is field research using descriptive evaluative approach. The primary sources of this research are field observation report and events occurred in RELASI JAYA Surakarta; while the secondary sources used in this research are book references, articles, and other researches. The data analysis technique of this research is descriptive analysis. The conclusion of this research is that the ulamas have different opinion related to Bay’ mu’āṭah law. According to ulama Syafi’i, a trading should be done with an akad (contract) that is directly spoken by either the seller or the buyer. Whereas ulama Hanafi, Hambali, and Maliki state that Bay’ mu’āṭah might be done without mentioning the akad (contract) directly as it has been a custom in the society. The researcher himself concludes that Bay’ mu’āṭah is legal to do because it occurs based on a custom and, generally, there is a willingness between each other. The practice of rounding off the change is also equated to Bay’ mu’āṭah since there is willingness between both the seller and buyer; and it has also become a custom in general society
