Rola parlamentów narodowych w świetle Traktatu Lizbońskiego

The aim of the article is to present the role of the national parliaments in the light of the Lisbon Treaty that officially came into force on the 1st of December 2009 in all member states of the European Union. The article presents the issue of the new competences of the national parliaments in the control of the observance of the subsidiarity rule in the legislation process as well as the problem of their consultative function in the "passerelle" procedure. The article is also an evaluation of the effectiveness of the early warning procedure and a review of the Treaty regulations strengthening the importance of the national parliaments in the functioning of the European Union. After entering into force of the Lisbon Treaty national parliaments gained the truly bigger influence on the legislation process in the European Union. The consequence of the strengthening of the position of the national parliaments may be a real and significant reinforcement of the democratic legitimacy of the EU as well as a clarification of the relations between EU and national parliaments by exercising legislative competencesCelem poniższego opracowania jest analiza roli parlamentów narodowych w świetle Traktatu Lizbońskiego, który w dniu 1 grudnia 2009 roku oficjalnie wszedł w życie we wszystkich państwach członkowskich Unii Europejskiej. W artykule przedstawiono problematykę nowych uprawnień parlamentów narodowych w procesie kontroli przestrzegania zasady subsydiarności (pomocniczości) w procesie prawodawczym oraz zagadnienie funkcji konsultacyjnej narodowych organów ustawodawczych w zakresie procedury uproszczonej zmiany. W artykule dokonano także oceny efektywności nowej procedury „wczesnego ostrzegania” oraz przeglądu regulacji traktatowych wzmacniających znaczenie parlamentów narodowych w funkcjonowaniu struktur europejskich. Po wejściu w życie Traktatu Lizbońskiego parlamenty narodowe uzyskały możliwość wywierania realnie większego wpływu na proces legislacyjny Unii Europejskiej. Następstwem wzmocnienia pozycji parlamentów narodowych może być rzeczywiste, istotne umocnienie legitymacji demokratycznej Unii, a także wyjaśnienie relacji Unii z państwami członkowskimi przy wykonywaniu kompetencji prawodawczyc
