CUSTOMS REGULATION OF THE INTELLECTUAL PROPERTY MARKET IN THE EURASIAN ECONOMIC UNION: THE PROBLEM OF AN ILLEGAL IMPORT

The relevance of this article is that, to date, cases of violations of intellectual property rights in foreign economic activity and foreign trade have increased. A special role in the regulation of the intellectual property market is assigned to the customs authorities that carry out customs regulation and control over the movement of intellectual property. The purpose of this study is to determine the place of customs authorities in the system of customs and customs control of the intellectual property market in the Russian Federation and the Eurasian Economic Union. The article analyzes the activities of the customs bodies of the Russian Federation in the field of protection, con­trol and movement of intellectual property objects across the customs border. As a result, the main lines of the Russian customs authorities activity to counteract the infiltration of counterfeit products into the Russian Federation have been identified, which include three components: the use of administrative liability tools, the for­mation and maintenance of the register of intellectual property ob­jects, and the fight against counterfeit in the post-customs control. Based on the identified problems of the system, the regulation of intellectual property in the field of customs and post-customs control proposed a system of measures that increase the efficiency of the work of customs authorities in the field of protection of intellectual property.Актуальность данной статьи заключается в том, что на сегодняшний день участились случаи нарушений прав интеллектуальной собственности во внешнеэкономической деятельности и внешней торговле. Особую роль в регулировании рынка интеллектуальной собственности отводится таможенным органам, которые осуществляют таможенное регулирование и контроль перемещения объектов интеллектуальной собственности. Цель исследования заключается определении места таможенных органов в системе таможенного и постаможенного контроля рынка интеллектуальной собственности в Российской Федерации и Евразийском экономическом союзе. В статье проведен анализ деятельности таможенных органов Российской Федерации в сфере защиты, контроля и перемещения объектов интеллектуальной собственности через таможенную границу. В результате выявлены основные направления деятельности таможенных органов России по противодействию проникновению на территорию РФ контрафактной продукции, включающие три составляющие: применение инструментов административной ответственности, формирование и ведение реестра объектов интеллектуальной собственности и борьба с контрафактом в рамках посттаможенного контроля. На основе выявленных проблем системы регулирование объектов интеллектуальной собственности в области таможенного и посттаможенного контроля предложена система мероприятий, повышающих эффективность работы таможенных органов в области охраны объектов интеллектуальной собственности
