????????? ?????? ??????????????? ????????????????????? ??????????????? ?????????????????? ?????? ???2015 ???????????? ????????????????????? ???????????? ????????? ??????????????? ??????.ABSTRACT The Protest of Public Opinion Against the 2015 Agreement on Japanese Military Sexual Slavery and the Alternative of Deliberative Democracy Kyong-ae Park Dept. of Civil Society The Graduate School of Public Policy Hanyang After announcing the policy decision of Korea Government called the 2015 Agreement on Japanese Military Sexual Slavery, the victims of Japanese Military Sexual Slavery and victim-supporting organizations thought it as the Agreement which excludes the position and opinions of the victims, and the researchers of Japanese Military Sexual Slavery evaluated it much more backward than the 1993 ???Kono Statement??? and the Asian Women???s Fund in 1995. Also the public opinion poll showed that the 63% of Koreans answered the 2015 Agreement should be renegotiated and the 84% of those thought Japanese government didn???t apologize for the matter of Japanese Military Sexual Slavery. The aim of this study is to restore ???Democracy Legitimacy??? and compensate 'Democracy Deficit' through the alternative of Deliberative Democracy about the problems of the victims of Japanese Military Sexual Slavery, researching the causes of the public opinions ??? the victims, the victim-supporting organizations, and the researchers of Japanese Military Sexual Slavery ??? against the 2015 Agreement To begin with, if we analyze the matter of the 2015 Agreement, we will be surprised at the opposite views between the Korean Government and Koreans - the victims, the victim-supporting organizations, and the researchers of Japanese Military Sexual Slavery. Korean government announced that its servants had had 15-time contacts or interviews with the victims of Japanese Military Sexual Slavery and victims-supporting or victims-related organizations in order to collect or coverage their opinions. On the other hand, the victims and their support organizations said they had never heard of or discussed the 2015 Agreement with the representative servant of the government before the policy decision of the 2015 Agreement. Therefore, the opposite views between Korean Government and the victims of Japanese Military Sexual Slavery and victims-supporting or victims-related organizations indicated that the government policy had no choice but to occur the protest of public opinion against the 2015 Agreement. Looking into the contents of the 2015 Agreement of Korean government, we can find three factors against public opinion ??? victims, history of past liquidation between Korea ??? Japan, and civic movement. The causes of the protest of public opinion against the government policy decision in the 2015 Agreement are that one is the exclusions of participation and collecting opinions of the victims of Japanese Military Sexual Slavery, the second is not admitting historical truth and ambiguous responsibility of the Japanese Military Sexual Slavery System and Inaction of Recurrence Prevention, the third, the requirements of NGO are nothing accepted by Japanese Government. If so, with what institutional system can the government resolve the protest of public opinion against the 2015 Agreement on Japanese Military Sexual Slavery in our institutional system called Democracy? This study suggests that the most preferable alternative of the protest of the public opinion against the 2015 Agreement is for Korean Government to accept the protest of the public opinion on its policy decision. Korean Government should accept the protest of people opinion, annul the 2015 Agreement, and resume the Agreement which has the actions of reparation of Justice and Damage for victims that have been suggested by the victims of Japanese Military Sexual Slavery, NGOs, and International Society. If the first alternative is hard to take actions because of the relations of gain and loss between Korea and Japan, as the second alterative of restoring ???Democracy Legitimacy???, the alternatives of Citizen-Participating Deliberative Democracy, the Consensus Conference and the Citizen's Jury are suggested. The Protest of Public Opinion Against the 2015 Agreement on Japanese Military Sexual Slavery is due to two failures of our democracy system, Representative Democracy. One is the failure of the representative and the other is the failure of deliberation when the government decides Policy. So, what are the institutional alternatives of these failures? It is through Citizen-Participating Deliberative Democracy. Particularly, in the case of the policy decision called the 2015 Agreement, the government has had an opposite view of the policy decision process with the victims of the Japanese Military Sexual Slavery and victims-supporting organizations ( the government announced that its servants had had 15-time contacts or interviews with the victims of Japanese Military Sexual Slavery and victims-supporting or victims ??? related organizations in order to collect or coverage their opinions, while the victims and their support organizations said they had never heard of or discussed the 2015 Agreement with the representative servant of the government before the policy decision of the 2015 Agreement). Therefore, this study's settlements are the Consensus Conference and the Citizen's Jury of Deliberative Democracy which has the conditions of Policy Deliberation( procedural principles) -Reciprocity, Publicity, Accountability- and the contents of Policy Deliberation( substantive principles) -Basic Liberty, Basic Opportunity, Fair Opportunity.Maste
