TINDAK PIDANA KORUPSI PENGADAAN BARANG/JASA PEMERINTAH DI RUMAH SAKIT UMUM DAERAH KOTA YOGYAKARTA ( STUDI KASUS PUTUSAN NO. 14/PID.SUS-TPK/2014/PN.YYK. )

Presidential Regulation No.54 of 2010 is expected to help reduce the amount of misappropriation of funds in the State budget. This study aims to determine the implementation of Presidential Regulation no. 54 of 2010 in the verdict no. 14 / Pid.Sus-Tpk / 2014 / Pn.Yyk. in the case of a criminal act of procurement of goods / services of the government at the Regional General Hospital of Yogyakarta.The research method used is Normative legal research that focuses on positive legal norms in the form of legislation as the main material and books, opinions of experts, mass media, and internet as supporting data.The results of this study indicate that the implementation of Presidential Regulation no. 54 of 2010 in the verdict no. 14 / Pid.Sus-Tpk / 2014 / Pn.Yyk. in the case of the crime of procurement of goods / services of the government at the Regional General Hospital of Yogyakarta indicates that PPK has directed to one particular brand / product because the technical specifications are only copied from certain product brochures, thus contrary to the provisions of Attachment II of Perpres 54 of 2010 letter A , number 2 on the Review of the General Procurement Plan, letter b number 3) b) clause (4) on the Clarity of Technical Specification of Goods, stating that "Not leading to certain brands / products except for spare parts procurement" and this opportunity is further utilized by the defendant as the Director of CV.
