PERTANGGUNG JAWABAN HUKUM PIDANA PELAKU KEKERASAN FISIK DALAM LINGKUP RUMAH TANGGA TERHADAP ISTRI (Studi kasus No: 96/PID.SUS/2015/PNYOGYAKARTA)

The title of the thesis is the perpetrator of physical violence against wife in a household environment’s responsibility in the criminal law (case study: 96/PID.SUS/2015/Yogyakarta). Violence in a household is each act against people that leads to physical, psychological, and sexual sufferings, Act No. 23 year 2004. This study aims to find information about the responsibility of physical violence against wife in the household environment’s perpetrator and to know the judge’s obstacles in dealing with criminal acts of physical violence in a household. The study employed normative law research method that focused on positive law in a form of regulations. The result of the study is the criminal law responsibility, of which the criminal law was not in accordance with the determined regulations. The judge was not able to decide optimally based on the applicable condition and the judge only followed the examination based on the indictment
