International audienceThe secession and de facto annexation of Crimea by Russia in March 2014 and the ongoing conflict between pro-russian separatists and the government in Eastern Ukraine raise major issues of international law. This article first shows that, contrary to Russian claims, the inhabitants of Crimea and Eastern Ukraine cannot rely on a « right to external self-determination » because this right was only granted to colonized peoples on the basis of the « salt-water » test. The article then examines whether the secession of Crimea should be considered illegal. Normally, outside the colonial context, « secession is not a question of law, but a question of fact » and the decisive criterion becomes thus the principle of effectivene...
