An approach to the regulation of mediation in Private International Law and European Law

En el presente artículo se realiza una aproximación a la mediación internacional y su regulación en el ámbito del derecho internacional privado (dipr) y del derecho europeo. En la primera parte se examina el concepto de mediación y las características propias que la diferencian de otros métodos alternativos de solución de conflictos (adr por sus siglas en inglés). En la segunda parte, se hace referencia al marco normativo que regula la mediación en el derecho internacional y el derecho europeo. En la parte final, el artículo se ocupa de los principales aspectos legales de la mediación internacional, relacionados con las cláusulas contractuales de sumisión a mediación y los contratos de mediación internacional.This article is an approach to the way international mediation is regulated in the field of Private International Law (PILaw) and European Law. In the first part, the concept of mediation and the characteristics that differentiate it from other methods of alternative dispute resolution (adr) is discussed. The second part is devoted to the regulatory framework governing mediation in International Law (Intl Law) and European Law. In the final part, the article refers to the main legal aspects of international mediation, contract clauses related submission to mediation, and mediation contracts in cross-border cases
