Champ juridique, juristes et règles de droit : une sociologie entre disqualification et paradoxe

Legal Field, Lawyers and Rules of Law : A Sociology between Disqualification and Paradox. Bourdieu's sociological analysis of law cannot be dissociated from his ongoing endeavor to explain the social world. The present reflection harks back to his ethnological work of the 1960s. The notion of habitus forms the main part of the article. Bourdieu adopts two approaches, going back in time, in order to establish a connection between habitus and the rule of law. First of ail he applies himself to legalism, undertaking to found an adequate theory of praxis. This, however, does not stop him from later questioning the effects of this legalism on social agents, thereby giving his sociology a paradoxical character. The legal field and the focus on the professionals who implement the rules of law rather than on the professionals who formulate them, are fondamental contributions of this sociology largely inspired by Weber.L'analyse sociologique de P. Bourdieu sur le droit est indissociable de son entreprise d'explication du monde social. La présente réflexion se greffe sur des travaux d'ordre ethnologique, entrepris dans les années soixante. L'habitus y occupe une place essentielle. Bourdieu accomplira deux démarches en sens inverse, dans le temps, pour mettre en relation habitus et règle de droit. Il cherchera d'abord à en découdre avec le juridisme, en s'efforçant de fonder une théorie adéquate de la pratique. Cela ne l'empêchera pourtant pas de s'interroger, plus tard, à propos des effets de ce juridisme sur les agents sociaux, donnant ainsi un caractère paradoxal à sa sociologie. Le champ juridique et l'attention portée aux professionnels qui mettent en œuvre les règles de droit, plutôt qu'à ceux qui les élaborent, constituent les apports fondamentaux de cette sociologie d'inspiration largement weberienne.Ocqueteau Frédéric, Soubiran-Paillet Francine.
