Sur la philosophie italienne du droit de tendance analytique

On Italian Analytical Legal Philosophy. This article presents a concise description of the origins and history of the Italian analytical school of legal philosophy and general theory of law, created in the 1950's and inspired by Norberto Bobbio's teachings. Despite its diverse theoretical positions, the Italian analytical school is characterized by a definite underlying unity originating from the importance accorded to the semiotic approach to law, derived itself from two fundamental principles : divisionism, the major division or logical rupture between the descriptive and the prescriptive ; and empirism, the distinction between analytic and synthetic judgements.L'auteur présente un tableau synthétique de l'origine et de l'histoire de l'école analytique italienne de philosophie et de théorie générale du droit, née dans les années 50 autour de l'enseignement de Norberto Bobbio. L'école analytique italienne, malgré la variété des positions théoriques qu'elle recouvre, présente un caractère fortement unitaire ; l'approche sémiotique du droit, qu'elle privilégie, s'inspire en effet de deux principes fondamentaux : le divisionnisme, c'est-à-dire la grande division et la rupture logique entre le descriptif et le prescriptif et l'empirisme, c'est-à-dire la distinction entre jugements analytiques et jugements synthétiques.Pintore Anna.
