Les Critical Legal Studies au pays du droit international public

The Critical Legal Studies Approach to Public International Law. This article, already published in the Revue québécoise de droit international, is an introduction to the Critical Legal Studies approach to public international law, an approach which can be roughly called neostructuralist. To offer this introduction, a very general presentation of the main theses of this movement is oftered. Following this general presentation, the article attempts an application of the methodology the CLS international legal scholarship suggests in the specific context of European Community law. The critique of a decision of the European Court of Justice furnishes an example of what an applied philosophy of law could resemble if the CLS teachings were followed and systematized.Cet article, déjà publié dans la Revue québécoise de droit international, se situe à l'intersection du droit international et de la théorie du droit. Son ambition est d'introduire à une branche particulière du mouvement des Critical Legal Studies, qui offre une lecture néo-structuraliste du droit international public. Après une présentation générale des thèses de cette branche critique du droit des gens, l'on tente de mettre en oeuvre la méthodologie qu'elle propose dans le contexte spécifique du droit communautaire. Au départ d'un arrêt de la Cour de Justice des Communautés européennes, c'est ainsi une philosophie du droit appliquée dont la possibilité est illustrée.De Schutter Olivier.
