On 3 February 2009 the International Court of Justice entered its judgment in the Case concerning Maritime Delimitation in the Black Sea (Rumania v. Ukraine). The unanimous judgment fi xes a demarcation line for the maritime border between the two states and settles a territorial dispute over Serpents’ Island. To this end, the ICJ traced a delimiting line by applying the “ equidistance-relevant circumstances” method. Based on the prior definition, within a defi ned relevant maritime area, of a provisional equidistance/ median line from the relevant coasts of the two states, the method then leads the Court to assess whether “ relevant circumstances” call for the provisional line to be adjusted or moved so as to achieve an “ equitable” outcom...
