From the perspective of Quebec law, the author examines the problems related to the recognition of facts and proof concerning moral harassment under French law, despite the fact that special provisions were introduced in the Labour Code when the Social Modernization Act was passed in 2002. Under both French and Quebec legislation, moral harassment is required to produce effects on the victim. More specifically, the French legislator imposes an effect on the employee’s health, dignity or rights or else on his or her career prospects being compromised.
