In the spring of 2002, the Canadian federal government presented another bill respecting assisted human reproductive technologies and related areas. In this context, it is relevant to review, from a critical point of view, the legal status of the foetus in Quebec and in Canada, in federal and provincial law. The first part of this article examines the legal status of the foetus in Quebec and Canada in the abortion context, in other criminal law situations, in the case of medical interventions on the foetus or on the pregnant woman, and in the child’s right to sue for damages incurred while in utero. The Supreme Court of Canada has progressively recognized women’s right to reproductive autonomy and the foetus’ lack of juridical personality. ...
