The limits of sovereignty. the changes of immigration law in france and the united states The exclusive control by the state over its territory is the main feature of sovereignty. The common tendency to consider sovereignty as a static concept has been continuously challenged in theory and in practice by international migration flows. Contrary to mainstream theoretical approaches that overemphasize the role of material capacity and utilitarian logic in the definition of state sovereign policies, the study stresses the independent role of « norms » in forging these policies. The main purpose is to show that both in France and the US, state control of migration flows is the result not only of political government choices but also of the form...
