La CSCE et les droits des minorités nationales

The CSCE and the Rights of National Minorities, by Eric Remacle The Conference on security and cooperation in Europe has addressed the question of the rights of national minorities with increasing interest, especially since the fall of the Berlin Wall and the heginning of the Yugoslav War. It has enlarged the concept of national minorities and recently recognised the complementarity of its individual and collective dimensions and its involvement in security as well as in human rights issues. The 1990 Copenhagen Document on the Human Dimension of the CSCE has defined widely the commitments of the participating states who more recently accepted that the rights of national minorities are not a purely internal affair. Lastly, the CSCE mechanism on the human dimension, reinforced in Moscow in 1991, and the creation of the function of High Commissionner for National Minorities by the Helsinki Summit in 1992 pave the way for a general System of protection for minorities. The use of these mechanisms during the Yugoslav War shows their usefulness but also their limits.La Conférence sur la sécurité et la coopération en Europe a examiné la question des droits des minorités nationales avec un intérêt croissant, surtout depuis la chute du mur de Berlin et le début de la guerre en Yougoslavie. Elle a élargi le concept de minorités nationales et a récemment reconnu la complémentarité de ses dimensions individuelle et collective ainsi que son implication tant dans les questions de sécurité que dans celles des droits humains. Le Document de Copenhague de 1990 sur la dimension humaine de la CSCE a défini largement les engagements des Etats participants qui ont accepté plus récemment le fait que les droits des minorités nationales ne sont pas de pures affaires internes. Enfin, le mécanisme de la CSCE sur la dimension humaine, renforcé à Moscou en 1991, et la création par le sommet d'Helsinki en 1992 du poste de Haut commissaire pour les minorités nationales ouvrent la voie à un système général de protection des minorités.
