The cultural logic of revolutionary law. This article is a study of how the monarchical concept of "extraordinary justice" was transformed into the republican concept of "revolutionary law " after the fall of the monarchy on August 10, 1792. It argues that although the revolutionaries borrowed the category of extraordinary justice from the Old Regime they put the concept to a novel use: instead of seeking to preserve an existing regime, they sought to use penal law create a new one. Revolutionary law thus marked a radical rupture from Old Regime understanding of emergency penal law.
