Economic Analysis of Law and Legal Pragmatism

本文主要涉及三个内容：第一，法律经济分析是法律实用主义研究方法的一个分支。一个国家的法律职业群体和学者在使用经济分析时，必须要考虑其制度结构和法律文化是否能容纳这种方法；第二，经济学的面目可能是可怕的，可能令人心生畏惧，但同时它也可能是使法律变得更为清晰、更符合直觉的有效工具；第三，作者目前关注的两个法律经济学问题：司法行为的实证分析，以及，世界经济危机和经济分析（包括法律经济分析）的失败。The article is on:First, economic analysis is closely related to or a branch of a pragmatic approach to law.The use of economic analysis of law by law-yers, judges, professors, and so on is relative to the character of the legal and polit-ical culture from which these individuals emerge and in which they function.Sec-ond, economics can be formidable, can intimidate, but it can also be an effective tool for making law clearer and more intuitive.Third, two topics that currently con-cern the author:empirical analysis on judicial behaviors, and the crisis of the world economy and a failure of economics in general and the economic analysis of law in particular.014-1
