International audienceIn this article, the author comments the decision of the Court of Cassation (31 January 2018) on the assessment of distinctiveness and repute in trademark law. This judgment reverses the judgment of the Court of Appeal of Lyon (13 May 2015) which considered the "Fiproline" trademark to be descriptive of the active ingredient "Fipronil". By this judgment, the Criminal Division of the Court of Cassation recalls that the assessment of the distinctiveness criterion must be assessed with regard to the goods concerned when the trade mark is filed and not when it is used. Moreover, the Court considers that the mark "Fiproline" makes up an imitation of the mark Frontline (plaintiff in this case) likely to cause confusion in the mind of the consumer in particular because of similarity auditory. According to the author, this last position is open to criticism. First, because there is a certain hesitation between the notion of imitation and the notion of damage to reputation. Secondly, because of the kind of packaging used, which can only be examined in the context of an action for liability for parasitism.Dans cet article, l’auteur commente la décision de la Cour de cassation en date du 31 janvier 2018 relative à l’appréciation de la distinctivité et l’atteinte à la renommée en droit des marques. Cet arrêt casse l’arrêt de la Cour d’appel de Lyon rendu le 13 mai 2015 qui avait considéré comme descriptive du principe actif « Fipronil » la marque « Fiproline ». Par cet arrêt, la chambre criminelle de la Cour de cassation rappelle que l’appréciation du critère de la distinctivité doit s’apprécier au regard des produits visés lors du dépôt de la marque et non lors de son exploitation. Par ailleurs, la Cour considère que la marque « Fiproline » constitue une imitation de la marque Frontline (demandeur dans cette affaire) susceptible d’engendrer une confusion dans l’esprit du consommateur notamment en raison d’une similarité auditive. Selon l’auteur, cette dernière position est critiquable. Premièrement, parce qu’un certain flottement entre la notion d’imitation et d’atteinte à la renommée transparait. Deuxièmement, en raison de l’appréciation du mode de conditionnement du produit qui ne peut faire l’objet d’un examen que dans le cadre d’une action en responsabilité pour parasitisme
