Penegakan Hukum Pidana Bidang USAha Perkebunan Kelapa Sawit dalam Hubungannya Menduduki Tanah tanpa Izin yang Berhak (Studi di Kabupaten Ketapang)

This thesis addresses the issue of criminal law enforcement in the field of oil palm plantations in relation to occupying land without permission are eligible (studies in the district ketapan). Legal research methods used are normative juridical approach to socio-legal research. Factors that cause deviations operations of oil palm plantations in conjunction occupying land without permission are eligible in the district is the first ketapan, human resources responsible for the management of the environment is still not good quality and quantity. Second, the Society / a certain person who often capitalize on the existence of the company for personal gain. Third, lack of socialization and firm approach to the community. Fourth, business-oriented company always ignoring the interests of the community. Fifth, the lack of law enforcement against corporate criminal occupied the land without permission are eligible. Legal remedy in case of land disputes is in the form of repressive efforts and do sue-sue in civil court. Efforts repressive important in order to provide a deterrent effect to the perpetrators of criminal acts related to land disputes. By providing the deterrent effect may increase the bargaining power is higher then it will be easier to make peace. Based on the above conclusions, the following suggestions are put forward that authorized institutions should increase surveillance and enforcing the law against companies that violate the provisions of the oil palm plantation business with the interests of the people who suffered losses. Ketapan District Government through the relevant regional work units must follow various reports / complaints, and provide a clear warning to companies that do not comply with the provisions of palm cultivation sawit.Untuk resolve land disputes, should first be resolved by way of prevention.
