Quelques grands types de systèmes fonciers traditionnels au Tchad

Major types of traditional Land tenure systems in Chad. Chadian systems of land tenure cannot be understood if no analysis is made of the social organization (i.e. joint family and politics) of the population on study, nor of the surroundings where these populations live. So, a distinction is made between farmers' and pastoral people's land tenure systems. A difference is made within the farmers' land tenure system, between the «sara» type in the sudanian area, the «massa-toupouri-mousseye» type in the areas tinder the Mid-Logone flood and the «hadjeraï» type in the mountains where people used to take refuge. In the pastoral people's civilizations, two types of land tenure systems are observed : that of the arabs who presently tend to leave the nomadic way of life and settle, and that of nomads (teda and daza) who let a desprised caste of peasants tied their soil. It is on the basis of those different land tenure systems that «feudal» states appeared in the Sahel area : the royal lineage, through is religious and fiscal power, gained prominent rights on the land.Les systèmes tchadiens de droits fonciers ne peuvent être compris si on n'analyse pas l'organisation sociale (familiale, politique, etc.) des populations considérées ainsi que le milieu dans lequel ces populations vivent. Ainsi, on distinguera les systèmes fonciers d'agriculteurs et ceux des éleveurs. Les systèmes fonciers d'agriculteurs peuvent être répartis en systèmes fonciers de type «sara» dans la zone soudanienne, de type «massa-tou-pouri-mousseye» dans les zones inondables du Moyen-Logone, et de type «hadjeraï» dans les zones refuges des montagnes. Chez les éleveurs, sont étudiés les systèmes fonciers des arabes en voie de sédentarisation et ceux des Téda et des Daza nomades qui confient leur agriculture à mie caste méprisée. C'est sur ces différents modes d'appropriation du sol que se sont construits les systèmes «féodaux» des Empires sahéliens : le clan, par son pouvoir religieux et fiscal, a acquis un droit éminent sur le sol.Magnant Jean-Pierre.
