Garantías constitucionales. La Constitución de 1978.

Treball Final de Grau en Criminologia i Seguretat. Codi: CS1044. Curs: 2016/2017This paper aims at the study of constitutional guarantees and what is related to all of them. With this pretext, the work uses several sou rces (Spanish Constitution of 18 69, Spanish Constitution of 1931 and Spanish Constitution of 1978 ), among others, thus achieving a turning point where you can see how the constitutional guarantees in history have changed A nd therefore how they have evolved. It is important to emphasize in the present work the way in which its theme has been shaped. At all times revolves around the main axis, the guarantees that our Constitution of 1978 establishes. This way it is possible t o be studying the amparo appeal, the institution of the Ombudsman, etc. But always with reference to the object of his study. The work tries to show those aspects that, knowing that they are many and impossible to treat them all in it, they are basic to un derstand what the Spanish State democratic and of right offers its citizens. Therefore, it is about the Fundamental Rights and freedoms also contemplating the existence of a more practical section besides the theoretical one where it illustrates comments o f sentences issued by the Constitutional Court in these matters . At the same time, we must mention that we also work (not in a broad way since in this case it would be more superficial) what is the sanctioning power and certain aspects related to it. Thus, it is possible to combine a whole legal theme of constitutional law in relation to the dogmatic part of the Constitution of 1978 that deals with a privileged structure because it represents something as important as the protection of a series of rights an d freedoms.Este trabajo tiene por objeto el estudio de las garantías constitucionales y lo relacionado con todas ellas. Con este pretexto, el trabajo se sirve de varias fuen tes (Constitución española de 18 69, Constitución española de 1931 y la Carta Magna vigente), entre otras, logrando así un punto de inflexión donde se puede observar cómo han cambiado las garantías constitucionales en la historia recie nte y por consiguiente cómo éstas han evolucionado. Es de destacar en el presente trabajo la forma cómo se ha ido configurando su temática. En todo momento gira alrededor del eje principal, las garantías que nuestra Constitución de 1978 establece. De esta manera se consigue y es posible estar estudiando el recurso de amparo, la institución del Defensor del Pueblo, etc. pero siempre con la referencia a cerca del objeto de su estudio. El trabajo trata de mostrar aquellos aspectos que, conociendo que son mucho s e imposibles de tratarlos todos en él, sí son básicos para entender lo que el Estado español democrático y de derecho ofrece a sus ciudadanos y ciudadanas. Por lo tanto, versa sobre los Derechos Fundamentales y libertades contemplando también la existenc ia de un apartado más práctico además del teórico en donde se ilustra comentarios de sentencias emitidas por el Tribunal Constitucional en estos asuntos. A su vez, hay que mencionar que también se trabaja (no ya de un modo amplio puesto que en este caso se ría más superficial) qué es la potestad sancionadora y ciertos aspectos relacionados con ella. Así, de este modo se logra conjugar toda una temática jurídica del derecho constitucional en lo referente a la parte dogmática de la Constitución de 1978 que ver sa sobre una estructura privilegiada por representar algo tan importante como es la protección de una serie de derechos y libertade
