Sul diritto all’istruzione come veicolo di integrazione delle seconde generazioni dell’immigrazione in Italia

This paper examines the main legal issues concerning the guarantee of the right to study for second generation immigrants. After summarising the statistical data regarding school and social integration of children with a migratory background, the article identifies the main legislative measures adopted in recent years, both at state and regional level, as well as the constitutional jurisprudence on the subject of the right to study, from the perspective of the constitutional principles on education. The final purpose of this contribution is to show that the effectiveness of the right to education for children of foreign origin is essentially conditioned by public policies on immigration and that with a more open law on the acquisition of italian citizenship for the second generation immigrants, many problems that emerged from this analysis could be solved.This paper examines the main legal issues concerning the guarantee of the right to study for second generation immigrants.
