LAS CORTES INTERAMERICANA Y EUROPEA DE DERECHOS HUMANOS EN PERSPECTIVA COMPARADA

As an important achievement of the modern international law, the Inter-American and European systems for the protection of human rights, have implemented subsidiary mechanisms of guarantee in order to remedy irregular situations involving human rights at a national level. The Inter-American Court and the European Tribunal, as jurisdictional organs in each system, have played a prominent role in the consolidation of the systems. However, although both systems share the same nature, object and purposes, significant differences arise regarding the operation of the mechanism of guarantee.Consequently, a comparative approach of the organization and activity of both courts (Inter-American and European), the nature and execution of their sentences, and the scope of reparations in each jurisdiction, allows us to find key factors to analyze the issue of their effectiveness. Como un gran logro del derecho internacional moderno, los sistemas interamericano y europeo para la protección de los derechos humanos, han implementado mecanismos subsidiarios de garantía con el objeto de remediar situaciones irregulares que comprometen derechos humanos en el plano nacional. La Corte Interamericana y el Tribunal Europeo, como los órganos jurisdiccionales por excelencia de cada sistema, han desempeñado un papel prioritario en la consolidación de los mismos. Sin embargo, aunque ambos sistemas comparten la misma naturaleza, objeto y propósitos, existen diferencias sobresalientes en cuanto al funcionamiento de los mecanismos de garantía. En onsecuencia, una aproximación comparativa a la organización y actividad de las dos cortes (Corte Interamericana y Tribunal Europeo), la naturaleza y ejecución de sus sentencias, así como el alcance de las reparaciones en cada jurisdicción, permite encontrar factores decisivos a la hora de efectuar un juicio sobre su eficacia.
