MORALIDAD, NATURALEZA Y LEY EN EL PENSAMIENTO DE SANTO TOMÁS

During its preponderance in Philosophy, Scholasticism always endorsed, with different degrees of strength, the idea of the transcendent and divine origin of positive law as a mere reflection and embodiment of what it has been called natural law. Because of this, positive law did not have its own criterion of validity; its validity, and therefore its very existence as law, was a moral criterion defined as the correspondence of law with natural law. Therefore, the relationship between Ethics and Law can be found in the centre of St. Tryweƒ thinking on natural law. Consequently, the need to study and to develop this subject within the boundaries of philosophy is manifest, thought one has to bear in mind that his point of departure lies in theological grounds. A lo largo de todo el pensamiento de la escolástica se siguió manteniendo, de forma más o menos matizada, el origen trascendente y divino del derecho positivo, que no es más que el reflejo y la manifestación de lo que podríamos denominar la ley natural. Esto hizo que el derecho no contara con su propio criterio de validez, sino que su criterio de validez y, en definitiva, de existencia como derecho, fuera un criterio moral consistente en la adecuación de éste a la ley natural. El problema de la articulación entre lo ético y lo jurídico en santo TOMÁS se encuentra, en consecuencia, en el centro de la reflexión filosófica sobre la ley natural. Se advierte, por tanto, la necesidad de estudiar y desarrollar este tema dentro del límite filosófico, sin por ello olvidar su punto de partida teológico.
