Los delitos contra el honor y la tutela del derecho a la vida privada de las personas

The present investigation originates for the interest of studying the problematics related to the influence of the penal procedure, which regulate the crimes against the honor, in the protection of the life deprived of the persons. The general aim that orientated the investigation was to determine if the penal procedure that regulate the crimes against the honor influence negatively the protection of the life deprived of the persons. The investigation was divided in two phases: theoretical and of field. In the first phase there was done a doctrinaire and legal analysis of the topic of study. In the second phase, 10 processes were studied on crimes against the honor, to observe since they come solving these processes and if the life deprived of the persons is protected; likewise, a survey was applied to 10 judges specialized in the penal of Trujillo on the topic of study, as well as to 20 criminal lawyers of the Bar association of The Freedom. For the compilation of the information there were in use the technologies of documentary collection, the signing, the survey and the observation; diverse instruments being elaborated as: bibliographical cards and of summary, leaf of record of information and the quaternion of survey. For the study of the information diverse methods were in use, since: the analytical, synthetic, inductive, deductive, hermeneutic and dogmatic method. For the organization of the information and his presentation there were used tables of statistical frequencies. The results demonstrated that the penal procedure that regulate the crimes against the honor do not protect due the life deprived of the persons. That is to say, they influence negatively the protection of the honor and the life deprived of the persons.La presente investigación se origina por el interés de estudiar la problemática relacionada con la influencia de las normas penales, que regulan los delitos contra el honor, en la protección de la vida privada de las personas. El objetivo general que orientó la investigación fue determinar si las normas penales que regulan los delitos contra el honor influyen negativamente en la protección de la vida privada de las personas. La investigación fue dividida en dos fases: teórica y de campo. En la primera fase se hizo un análisis doctrinario y legal del tema de estudio. En la segunda fase, se estudiaron 10procesos sobre delitos contra el honor, para observar como se vienen resolviendo estos procesos y si se protege la vida privada de las personas; asimismo, se aplicó una encuesta a 10 jueces especializados en lo penal de Trujillo sobre el tema de estudio, así como a 20 abogados penalistas del Colegio de abogados de La Libertad. Para la recolección de los datos se utilizaron las técnicas de acopio documental, el fichaje, la encuesta y la observación; elaborándose diversos instrumentos como: fichas bibliográficas y de resumen, hoja de registro de datos y el cuadernillo de encuesta. Para el estudio de la información se utilizaron diversos métodos, como: el método analítico, sintético, inductivo, deductivo, hermenéutico y dogmático. Para la organización de la información y su presentación se emplearon tablas de frecuencias estadísticas. Los resultados evidenciaron que las normas penales que regulan los delitos contra el honor no protegen debidamente la vida privada de las personas.
