International audienceThe 10 august 2011 Act making written reasoned mandatory for Major Crime (Assize) courts narrows its scope to the issue of the guilt and not the penalty. The article 365-1 of the French penal procedure Code stipulates that "reasoned orders are to mention the major prosecution elements that contributed to the court's conviction", with no mention to the penalty sentence. The criminal chamber of the supreme Court rules out such reasoned orders concerning the latter in three jurisprudential orders (Feb. 8th, 2017). However, interviews with law professionals show a growing interest for this and many among them are in favor.
