International audienceCommunity Directive 2008/115/EC, known as the Return Directive, establishes common standards for EU Member States in order to pursue a more protective policy for illegally staying third-country nationals who have to be expelled from the territory. The directive favours voluntary rather than forced repatriation and aims to ensure, in any event, respect for the fundamental human rights of those who are in an illegal situation on the territory of one of the EU Member States and who are waiting to be expel from it.
