Das Naturrecht als Kategorie des katholischen Kirchenrechts / Natural Law as a Category of Catholic Canon Law

The question of the meaning, the scope and the understanding of the concept ius divinum is relevant not only for canon law studies but also for all other theological disciplines, especially systematic theology. But this is more than an intra-theological question; it is at the same time an interdisciplinary and interfaith question. The present chapter examines the role of natural law as a basis for canonical norms in Catholic canon law.2 First, the place of natural law within the body of law of the Catholic Church is described, and then selected legal norms derived from natural law are considered. Die Frage nach der Bedeutung, der Tragweite und der Begründung des Begriffs Ius divinum betrifft nicht nur die Kanonistik, sondern ebenso alle anderen theologischen Disziplinen, insbesondere die systematische Theologie. Es handelt sich aber nicht nur um eine intratheologische Frage, sondern zugleich um eine interdisziplinäre und interreligiöse Frage. Im Folgenden wird aus der Perspektive des katholischen Kirchenrechts das Naturrecht als Begründungskategorie kirchenrechtlicher Normen untersucht. Zunächst wird der Ort des Naturrechts in der Rechtsordnung der katholischen Kirche dargestellt, um sodann einen Blick auf einige ausgewählte naturrechtlich begründete Rechtsnormen zu werfen
