The article analyzes the problem about the recognition of atypical forms of Family, from the John Rawls’ theory of justice as fairness. It presentes Rawls’ concept of Family, developed after Susan Okin contributions. Shows the evolution of family’s concept in western societies to its contemporany notion. Interprets the issue from the political focus of Rawls’ theory, reflecting about the conclusions that can be extracted to the legal-dogmatic field. Concludes that the Constitution should be interpreted broadly; also that there is a need for institutions that can ensure basic rights for these forms of Family
