This research has the objective of demonstrating the importance of the decisions of the International Tribunals, specifically the European Court of Human Rights, for the refinement of human / fundamental rights standards. Therefore be devoted, at first, to identify the semantic concept of a rule, which will put the legal hermeneutics in evidence; and, punctuate the question of the standard of identification of the opening due to the ethical and moral content inserted into legal norms that prescribe human / fundamental rights.
