Using categories from authors affiliated to the Marxist theory (Marx, Pachukanis, Baratta) and tributaries of its method, the materialist dialectical, this paper aims to understand the nature of Law, asking about its key aspects, such as validity and purpose. For explanatory purposes, it also examines the Marxist analysis of criminal law, pointing to a more elaborated comprehension of the role of the legal phenomenon in the modern industrial class societies
