Penegakan Hukum terhadap Tindak Pidana Illegal Logging di Kalimantan Barat oleh Ppns Kehutanan Sporc (Menurut UU No. 41 Tahun 1999 dan UU No. 18 Tahun 2013)

Illegal logging activities is one of the extraordinary crime in forestry. One of the areas in Indonesia that flare illegal logging activities are West Kalimantan Province, which is rich in natural resources and the forest. One of the efforts to protect the forest from any forest area disturbances, then in 2005, Department of Forestry (now is Ministry of Environment and Forestry) has formed Quick Reaction Ranger Unit (SPORC), and Civil Servant Investigators Forestry (PPNS Kehutanan) SPORC. The general objective of this study was to determine, obtain data and analyze information about the enforcement of the law by PPNS Kehutanan SPORC against illegal logging activities in West Kalimantan by Law No. 41 Year 1999 concerning Forestry and Law No. 18 Year 2013 concerning the Prevention and Eradication of Forest Destruction. The kinds of this research was empirical juridis research by qualitative descriptive. The research used primer and secondary data. The technique of collecting data used document study and interview technique. The technique of determine the research sample used non-probability sampling technique. The result of this research show that the law enforcement to the doer illegal logging by PPNS Kehutanan SPORC in West Kalimantan has been running quite optimal, it is known that there are 81 cases, 70 cases have been P-21, 68 suspects and 13 types of evidence which is the result of a process of law enforcement against illegal logging activities in the period 2006 to 2016. With the repealed and declared no effect of Article 50 Paragraph (3) h of Law No. 41 Year 1999 as provided for in Article 112 of Law No. 18 Year 2013, then the 11 cases still in the investigation process will be constrained, on the other hand PPNS Kehutanan SPORC continue to use Law No. 41 Year 1999 in the process of the investigation of 11 cases. The existence of multiple interpretations of the Decision of the Constitutional Court (MK) No. 45 / PUU-IX / 2011 dated February 12, 2012 and Article 110 paragraph b of Law No. 18 Year 2013 could be its own obstacles in law enforcement will be done by PPNS Kehutanan SPORC. For smoothly investigation process, the function of coordination with the police and prosecutors must be improved so that the case can be resolved up to P-21.
