Intellectual goods in the public domain

El presente artículo analiza la noción y origen del dominio público, así como las creaciones de libre utilización que lo integran a la luz de los derechos de propiedad intelectual (DPI), revisando tópicos de interés como la territorialidad de éstos y las implicaciones particulares de las diferentes categorías de los mismos. En este sentido, se examina el pase al dominio público de las obras objeto del derecho de autor y las creaciones protegidas por los derechos de propiedad industrial, como invenciones, marcas comerciales y variedades vegetales. Asimismo, trata otros bienes intangibles no protegidas por DPI como los conocimientos tradicionales y el folclore.36-51astudillofrancisco@yahoo.comThis article analyzes the concept and the origin of the public domain in relation to Intellectual Property Rights (IPR). It refers to works, inventions and ideas that are not covered by IPR and they are available for use by members of the public without restrictions. Also it reviews different topics of interest of IPR always in relation with the public domain such as territoriality principle and the fall into the public domain of the works subject to copyright, inventions patented and other intellectual goods protected by IPR like trademarks and plant varieties. Moreover, it treats other intangible assets not protected by IPR as traditional knowledge and folklore
