Protection to the people displaced by armed conflict

La protección de las personas y bienes en situaciones de Conflicto Armado se confía a la especial regulación del Derecho Internacional Humanitario que es una rama del Derecho Internacional Público; sin embargo, en determinadas situaciones de desplazamiento vinculadas a solicitudes y estatutos de refugio, aplica el Derecho Internacional de los Derechos Humanos especializado en el área de Refugio, o Derecho al Refugio como se le conoce comúnmente. En el presente artículo se harán algunas precisiones acerca del ámbito de aplicación del Derecho Internacional Humanitario y su articulación con el Derecho de personas en situación de Refugio, las obligaciones de los Estados en relación con los movimientos de personas y el papel de las organizaciones internacionales que coinciden en sus objetivos de brindar protección a las poblaciones movilizadas.141-163jcsainz@cantv.netThe protection of people and property in armed is guaranteed by the International Humanitarian Law, which is a branch of the International Public Law. However, International Human Rights Law, in particular Refugee Law, could deal with certain cases of people demanding the refugee status. Some reflections about the jurisdiction of the International Humanitarian Law and its articulation with the Refugee Law are presented in this paper. Similarly, the paper considers the state’s duties regarding the movement of people and the role played by International Organizations that also aim at protecting displaced people
