THE LIMITATION OF PENAL LAW IN THE EXERCISE OF BUSINESS CITIZENSHIP

<p>The Criminal Law needs to be a real implement to achieve the preservation of the criminal goods in the Democratic State ol Law, acting as the necessary tool for the society. This way, society should constantly judge the criminal preservation benefit which are intolerable, to reach the perfect understanding between the citizens. The criminal laes due legislative process should be observed for the appropriated answer to the society´s wishes, always with the observation of the criminalization delegation emitted by the Federal Constituion of 1988, that completed 18(eighteen) years of its promulgation, where are related the criminal references that the State as a legitimed detainer of the right to punish should act.This point of view, Criminal Law has the duty to be accommodated to other ways to reach its ethics behavior. The Criminal Law´s Ethics will be reached, for example, by offering to the enterpriser criminal opportunity to help the society, keeping the social skin even business relations. Questions may appear in this application: Criminal Law´s Ethics will only be acchieved when the its legislator observes the real incumbence of the law group, which is criminal goods preservation and occasional punishment application in front of positive case. Will we continue using the Criminal Law as one implement of <i>prima ratio</i> to deal with the behaviors or we will using Criminal Law only as <i>ultima ration</i> application. This article has the purpose of examination of Criminal Law´s ethics and its properties, to reach corporative citizenship.
