This article has as main objective to analyze, initially, how happened the legal regulation of social inclusion of people with disabilities in ordinary education, searching, then, to specify the questioning on the issue regarding the access to higher education. Therefore, a possible concept of inclusion will be studied, especially from a Habermasian perspective. Finally, there will be argued the thesis that the inclusion of people with disabilities in higher education demands more for new educational and pedagogical policies, than for new normative documents.
