Tinjauan Yuridis Supporting Management Pada Kontrak Franchise Di Surakarta Berdasarkan Peraturan Menteri Perdagangan Republik Indonesia Nomor 53/M-DAG/PER/8/2012 Tentang Waralaba

Franchise is one way to develop a business or a business. Business franchise is a long-term cooperation between the franchisor with the franchise, not the sale and purchase of ordinary business. In a cooperation, of course there are rights and obligations of each party. The rights and obligations of each of these parties must have legal certainty so as not to harm the parties in the future. To provide legal certainty that we must make a franchise contract. The purpose of this study are as follows: 1. To know the contents of the contract regarding supporting management on franchise agreement 2. To know the dispute settlement franchise agreement related to supporting management. The type of research used is juridical empirical approach to the law of the Ministerial Regulation No. 53 / M-DAG / PER / 8/2012 About Franchise as a norm or rule by through approach to society, in the sense of seeing the reality that happened to the franchise business and constraints In franchising business. The results obtained are: a). The cooperation agreement between franchisor and franchise is in accordance with Regulation of the Minister of Trade of the Republic of Indonesia No: 53 / M-DAG / PER / 8/2012 on franchising contained in article 27 paragraph (1) "franchisor obliges to provide guidance to franchisees". Paragraph (2) "guidance as referred to in paragraph (1), a) Education and training on franchise management system management in cooperation so that the franchisee can carry out its franchise activities properly and profitable; b) Routinely provide management operational guidance, so that if found operational errors can be overcome immediately; c) Assist market development through promotions, such as through advertisements, leaflets / catalogs / brochures or exhibitions; And research and development of markets and products marketed, so as to suit the needs and can be received with the market well. b). The dominant problem experienced by deny is about market segment or marketing, which the product of cracker and macaroni that is sold have many competitors or competitors.
