Principio de legalidad y reserva de ley en materia tributaria : El caso del impuesto a los consumos especiales en materia de telecomunicaciones

As objective of this research I have raised this to make a critical analysis that how was been established the tax named as Special Consumption Tax on the services of Telecommunications, later this tax was repealed by the National Constituent Assembly of 2007-2008. Any tax on the technical legal practice must be established by law, based on two constitutional principles such as Principles of Legality and the Principle Reserve Act, to establish a tribute not only means to named it have to contain its essential elements as fact generator, tax base, and subject fare, if the tax does not contain this basic elements would be illegal and unconstitutional, as happened with the Special Consumption Tax on the services of Telecommunications that lacked these essential elements that should be imposed only by regulation having the force of law. Complementing this investigation tried each of the elements of tribute and the similarities and differences between the Principles of Legality and Reserve Act, from the standpoint of doctrine and jurisprudence.Como objetivo de esta investigación me he planteado el hacer un análisis crítico a la forma en que estuvo establecido el antes vigente Impuesto a los Consumos Especiales a los servicios de Telecomunicaciones, impuesto que luego fue derogado por la Asamblea Nacional Constituyente del 2007-2008. Todo impuesto en la técnica jurídica práctica debe estar establecido por ley, en base a dos principios constitucionales como son el Principio de Legalidad y el Principio de Reserva de Ley, el establecer un tributo significa no solo enunciarlo sino que el mismo contenga sus elementos esenciales hecho generador, base imponible, sujetos y tarifa, de no contener los mismo el impuesto sería ilegal e inconstitucional, como sucedió con el ICE a las Telecomunicaciones que carecía de dichos elementos esenciales que debieron ser establecidos única y exclusivamente por norma con rango de ley. Como complemento de esta investigación trató cada unos de los elementos del tributo y las similitudes y diferencias entre el Principio de Legalidad y Reserva de Ley, desde el punto de vista de la doctrina y jurisprudencia
