La exibilidad y justiciabilidad del derecho a la educación básica, obligatoria en términos de gratuidad en el Ecuador

The right to free primary education has been classified by the Doctrine as an economic, social and cultural right (ESCR), and recognized in International Law in: the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights, the American Declaration of Rights and Duties of Man, and the Protocol of San Salvador. Ecuador’s Political Constitution, its Children’s Law and Education Law recognize and guarantee this right. Some consider the ESCR to be programmatic rights that require progressive obligations from States and that depend on their available resources; and are therefore considered non enforceable and non justiciable in national and international courts. Is the right for free and mandatory education enforceable and justiciable in Ecuador? This thesis will analyze that this right is, as a matter of fact, enforceable and justiciable in this country. There are minimum legal duties in relation to mandatory, free, and primary education as well as international standards in regards to education that all States are expected to meet; also, because our legislation counts on constitutional actions that protect human rights, on judiciary actions and administrative procedures that come in the Children’s Law and on actions within the Department of Educational Supervision of the Ministry of Education and Culture.El derecho a la educación básica, obligatoria y gratuita, ha sido clasificado por la Doctrina como un derecho económico social y cultural (DESC), reconocido en el ordenamiento jurídico internacional por la Declaración Universal de DDHH, el Pacto Internacional de Derechos Económicos Sociales y Culturales, la Declaración Americana sobre los Derechos y Deberes del Hombre y el Protocolo de San Salvador. En nuestra legislación lo garantizan la Constitución Política, el Código de la Niñez y Adolescencia y la Ley Orgánica de Educación. Para algunos, los DESC son derechos programáticos, que generan obligaciones progresivas de prestación para los Estados y que dependen de sus recursos disponibles, por tanto gozan de poca exigibilidad y justiciabilidad ante los tribunales nacionales e internacionales. ¿Es exigible y justiciable el derecho a la educación básica, obligatoria y gratuita en el Ecuador? En esta tesina se analiza que este derecho sí es justiciable en virtud de la existencia de contenidos mínimos esenciales respecto a la obligatoriedad, gratuidad y educación básica y de estándares internacionales sobre educación, que los Estados están obligados a cumplir, y porque la legislación ecuatoriana cuenta con acciones concretas como: el Amparo Constitucional, la Acción Judicial de Protección, las Acciones Administrativas de Protección de los Derechos y acciones a través de la Supervisión Educativa del Ministerio de Educación y Cultura
