PANDANGAN TOKOH-TOKOH NAHDLATUL ULAMA (NU) DAERAH ISTIMEWA YOGYAKARTA TERHADAP PUTUSAN MAHKAMAH KONSTITUSI (MK) NO. 46/PUU-VIII/2010 TENTANG STATUS ANAK DI LUAR NIKAH

Status of children in the family will determine the rights and obligations of the parents. Status of children in Islamic law called lineage, and legal validity depends on the relationship between father and mother. Constitutional Court on February 17, 2012, issued Decision No.. 46/PUU-VIII/2010 about the status of a child out of wedlock that states a child out of wedlock have a civil relationship with the biological father to prove it using science and technology. The decision generated much debate, so that authors see interesting things if this phenomenon is discussed with a view of figures of Islamic society organizations, the Nahdlatul Ulama in Yogyakarta Special Region. [Status anak dalam keluarga sangat menentukan hak dan kewajiban dari orang tuanya. Dalam hukum Islam status anak disebut nasab, dan sah tidaknya bergantung pada sah tidaknya hubungan antara bapak dan ibunya. Mahkamah Konstitusi pada tanggal 17 Februari 2012, mengeluarkan Putusan No. 46/PUU-VIII/2010 tentang status anak di luar nikah yang menyatakan anak di luar nikah mempunyai hubungan perdata dengan bapak biologisnya dengan membuktikannya menggunakan ilmu pengetahuan dan teknologi. Putusan tersebut menimbulkan banyak perdebatan, sehingga penyusun melihat ada hal yang menarik jika fenomena ini dibahas dengan pandangan tokoh-tokoh organisasi masyarakat Islam, yaitu Nahdlatul Ulama di Daerah Istimewa Yogyakarta.
